• Service: The SaaS platform provided by aqrmenu.com that allows Restaurants to create and manage digital menus, online orders, reservations, and other related services.

• Restaurant / User: The business entity (e.g., restaurant, cafe, hotel) that subscribes to our Service. "You" and "your" refer to the Restaurant.

• End-Customer: The individual who accesses the Restaurant's digital menu or services through the QR code or link generated by our platform.

• Subscription Plan: The specific package of services (e.g., Trial Basic, Basic Menu, Online Order, Pro Menu) that a Restaurant subscribes to.

• User Content: Any data, text, images, logos, menu items, prices, and other information uploaded or provided by the Restaurant to the Service.

• Eligibility: To use our Service, you must be at least 18 years old and have the legal authority to bind your business to these Terms.

• Account Creation: You must register for an account to access the Service. You agree to provide accurate, current, and complete information during the registration process.

• Account Security: You are responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

• Fees: The Service is provided on a subscription basis. You agree to pay the fees associated with your chosen Subscription Plan as displayed on our pricing page.

• Billing Cycle: Subscription fees are billed in advance on a recurring monthly or yearly basis ("Billing Cycle").

• Automatic Renewal: At the end of each Billing Cycle, your subscription will automatically renew under the same conditions unless you cancel it or we cancel it.

• Payment: All payments are processed through a secure third-party payment processor. You must provide valid payment information.

• Price Changes: We reserve the right to modify our subscription fees at any time. We will provide you with at least 30 days' prior notice of any fee changes.

• Cancellations: You may cancel your subscription at any time. The cancellation will take effect at the end of the current Billing Cycle, and you will not be charged for the next cycle.

• Refunds: Subscription fees are non-refundable, except where required by law. No refunds or credits will be provided for partial months of service or for periods where you did not use your account.

• License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service strictly in accordance with your Subscription Plan and these Terms.

• Restaurant Responsibilities:

  • You are solely responsible for all User Content you upload. You warrant that you own or have the necessary rights to all User Content and that it does not violate any third-party rights or applicable laws.

  • You are responsible for the accuracy of your menu information, including item names, descriptions, prices, and allergen information.

  • You are responsible for the quality, safety, and legality of the food and services you provide to your End-Customers.

  • You agree to comply with all applicable local laws and regulations regarding your business operations, including food safety, licensing, and consumer rights.

• Ownership: You retain all ownership rights to your User Content.

• License to Us: By uploading User Content, you grant us a worldwide, royalty-free license to host, display, reproduce, and distribute your User Content as necessary to provide and promote the Service.

• End-Customer Data: You acknowledge that you are the data controller of your End-Customers' personal information (such as names, orders, and contact details). You are responsible for complying with all applicable data protection laws (like GDPR, etc.) and must maintain your own privacy policy. aqrmenu.com acts as a data processor on your behalf.

All rights, title, and interest in and to the Service itself (including but not limited to the software, design, text, graphics, and logos) are and will remain the exclusive property of aqrmenu.com and its licensors. You may not copy, modify, or reverse engineer any part of our Service.

• Termination by You: You can terminate your account at any time by canceling your subscription through your account dashboard.

• Termination by Us: We may suspend or terminate your account and access to the Service immediately, without prior notice, if you breach these Terms, fail to pay your subscription fees, or engage in any activity that is harmful to our platform or other users.

• Effect of Termination: Upon termination, your right to use the Service will cease immediately. We may, but are not obligated to, delete all of your User Content from our servers.

• Disclaimer of Warranties: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, that the Service will be uninterrupted, error-free, or secure.

• Limitation of Liability: To the maximum extent permitted by law, aqrmenu.com, its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, or goodwill, arising from your use of the Service or any interaction between you and your End-Customers.

• Disputes with End-Customers: We are not a party to any transaction or dispute between you and your End-Customers. You agree to release us from any and all claims arising from such disputes.

You agree to defend, indemnify, and hold harmless aqrmenu.com and its employees, directors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: a) your use of and access to the Service, or b) your violation of these Terms or any applicable law.

These Terms shall be governed and construed in accordance with the laws of the Arab Republic of Egypt, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Giza, Egypt.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
